Status Of Terms

We provide true, accurate, current and complete information about you as prompted by our registration form (such information being the "Registration Data"); and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Luxlight has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Luxlight has the right to suspend or terminate your account, cease supply and refuse you any and all current or future use of the Luxlight site (or any portion of it).

Place of performance and applicable law

Luxlight is a company registered in England. Unless otherwise specified, the materials on this site are directed solely at those who access this site from the United Kingdom mainland. Luxlight makes no representation that any product referred to in the materials on this site is appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. English law shall govern this Agreement.

You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement.

Placing An Order

When placing an order with Luxlight you have to have read and agree with the terms and conditions prior to completion of your order.

A notice will be displayed on your web browser before you submit an order with Luxlight. This contains important information such as a description, price and delivery charges of the goods ordered. Luxlight suggests that you print off a hard copy of the notice or save a copy to your hard drive for your own records

All prices and charges on this site are in UK pounds. They include any VAT payable. Delivery charges are included in price if ordering to a permanent address within the UK mainland. Order made to be sent abroad, outside UK mainland and some remote parts of Scotland will be subject to extra postage charges that must be paid for by the customer.

The total cost of your order will be the price of the products you order and additional delivery charges is applicable.

Prices, offers and products are subject to availability and may change before, but not after, we accept your order. If something becomes unavailable we may offer you an alternative or contact you to cancel your order.

We will deliver the Goods to the address you give us for delivery on the order form.

We will make every effort to deliver the Goods as soon as possible.

Orders accepted after 12pm (noon) on a working day will not ordinarily be dispatched until the following working day.

You will become the owner of the Goods when they have been delivered to you. Once the Goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

We try very hard to ensure that all information on this site is accurate. However, just occasionally, an error can occur. If we discover an error in the price or description of a product you have ordered, we may cancel your order at any time up to the point we send you the product(s) (even if you have received your order confirmation email). We will contact you where we become aware of an error and ask whether you wish to continue with your order at the correct price or cancel it. If we do cancel your order, you will receive a full refund of any charges paid in advance. But not any fees incurred like interest or currency fluctuations if buying from outside the UK

We shall have no liability to you for any failure to deliver goods or any delay in doing so or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident

Right for you to cancel your Order

You have the right to cancel your purchase at any time either before or up to 14 days following the day you receive the goods by.

Once you have notified us that you are cancelling your contract, any sums paid to us for the goods (but not the delivery charges) will be returned to you or re-credited to your account as soon as possible provided that the goods are returned by you and received by us in the condition (including any accessories, packaging, instructions etc.) that they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the Goods from the amount to be re-credited to you.

We reserve the right to charge a restocking fee if the customer returns products in a poorer condition than what they received or with missing original packaging.

Right for us to cancel your order

We reserve the right to cancel your order up to any point before delivery if we do not have sufficient stock to deliver the goods, we do not deliver to your area/country, if one or more of the goods was listed an incorrect price.

If we do cancel your contract we will notify you by e-mail and will return to you any sums paid as soon as possible (usually the same day). We will not be obliged to offer any additional compensation for disappointment suffered.

Returns Policy

We offer a 14 day returns period on our items and will offer a full refund when the following conditions are met;

The item(s) is complete and in ‘as new’ saleable condition ( if any packaging has been opened to look at the product you must have done so without damaging / marking the product or the packaging)
Any use of the item has only been to examine it to ensure suitability; the item has no obvious evidence of heavy use such as scratches or marks. We do not sell items on a trial basis.
It is returned with the original box, all packaging and all accessories included with it. (when returning a kit all original packaging for all items must be included)
You have proof or purchase
We will also accept a return within the 14 day returns period when an item does not meet the conditions above and has been opened, used, or is missing packaging but we will make a deduction from any refund total if the value of the goods has been reduced.

Until goods are returned to us you must take reasonable care of the item(s). Any use or damage to the item(s) or product packaging beyond that necessary to inspect the goods on delivery may result in a re-stocking charge to cover loss that we reasonably expect to incur in re-selling the item(s)

Subject to the right of consumers to return goods for refund under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015, Luxlight does not sell products on a trial basis. We advise all customers to check suitability and specifications of products before making any orders. Items returned because of failure to check suitability and specifications may result in a deduction from the refunded total.

The Buyer, under the Distance Selling Regulations 2000, has the statutory right to return any product/s the Buyer has purchased within fourteen (14) working days after the delivery for any reason, even if the Buyer has simply changed their mind. This can be either part of or the whole order. If the fourteen (14) days have expired then the Seller is unable to accept a return unless the item is faulty by a manufacturing reason. The Buyer must inform the Seller in writing (email) or by telephone 0191 2803364 within fourteen (14) working days. The Seller will contact the Buyer and arrange any collection that is required. Once the goods have been returned to the Seller, the Seller will inspect the goods and if returned in its original condition and original packaging the Buyer will be entitled to a refund of the goods less delivery charges and collection charges. Please note the Buyer will be informed of the costs from the Seller before the return is finally agreed between the two parties. The Seller must return the agreed refund within 30 days from receipt of goods at the latest. The goods must be returned in its original condition and in its original packaging, no other method is acceptable and the Seller has the right to refuse return. The Buyer does have the right to return the goods by their own means but the Seller will take no responsibility for the condition that the goods arrive in. The Seller has the right to refuse delivery of the return by other sources if the goods are not in their original packaging or the goods are clearly damaged by the delivery method at point of delivery/return. The refund will not include a non refundable deposit value if an item is bespoke or classed as non-standard.

Content

Luxlight shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on this site. Luxlight will only be liable for consequential losses within the contemplation of the parties

All complaints are taken seriously and will be investigated as soon as they are brought to our notice. We will endeavour to rectify any problems as soon as possible.

Privacy Policy

The Seller does not and will not pass any information onto any third parties other than what is necessary to carry out the Order Contract to completion.

Law

The Seller is an English company and all sales and terms and conditions are governed by English Law. If the Buyer is a resident outside England and Wales and/or wishes the delivery to be outside the borders of English Law boundaries then it is hereby agreed that any disputes will only and always be governed by English Law.

Copyrights

All designs, text, graphics and their selection and arrangement on this site are the copyright of Luxlight or its content providers. As a visitor to the Luxlight site you are licensed to copy electronically or to print portions of this site for your own personal, non-commercial use. Any other use of materials on this site without Luxlight’s prior written consent is strictly prohibited.

Warranty

All of our products come with a 6 month warranty unless stated otherwise in the description, Light bulbs, flash tubes & modelling bulbs are excluded and come with a 30 day warranty.

The warranty applies to domestic use only and shall not apply to any products used for commercial purposes including rental lease use.

The above warranty excludes: accidental damage & misuse; wear & tear; faults caused by shock or fall, sand, dust, dirt, damp or corrosion, fire, theft, attempted theft, accidental or malicious damage, vandalism, water contamination or ingress, frost, flooding or other adverse weather conditions, repair or cleaning by unauthorised personnel; faults that have occurred because you have not used, stored or handled the product properly or have not followed written instructions for use the product; damage or defect due to wilful neglect or negligence by anyone other than us; faults due to the connection of other fittings or accessories to the product which we have not approved.

Entire Agreement

These terms and conditions, together with our current website prices, delivery details and contact details set out the whole of our agreement relating to the supply of the Goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any Goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
